Virginia Mom Convicted for Letting Her 5-Year-Old Walk Half a Mile Alone

Karyann Parkinson, a Williamsburg mother of five and a William & Mary law student, was convicted of contributing to the delinquency of a minor after she let her 5-year-old son walk roughly half a mile back to a community pond to collect goose feathers. The route ran along a sidewalk buffered from the road, with two marked crosswalks he had used safely many times, inside a gated community with 24-hour security and a 25-mph limit. A passerby flagged security, which escalated to police and Child Protective Services; the confrontation was sharpened by Parkinson’s refusal to cooperate with the responding officer.

The consequences are heavy relative to the conduct. A judge handed down a six-month jail sentence, immediately suspended pending good behavior, but the misdemeanor conviction stands and could jeopardize her ability to volunteer at her children’s schools or obtain a law license. Separately, CPS substantiated a ‘Level 2’ lack-of-supervision finding and placed her on the state child-abuse-and-neglect registry for seven years. The family is appealing.

The case is notable because Virginia passed a ‘reasonable childhood independence’ law in 2023 — unanimously — defining neglect as exposing a child to serious, obvious danger. Advocates argue the delinquency charge was used to route around that statute, since no evidence showed the boy was actually endangered or incapable of the walk he had already completed. Her pro bono attorney contended the only real ‘evidence’ was the child’s age plus a list of hypothetical harms, the same hypotheticals that would equally indict any parent who drives a kid to the store.
