Sony Sued Over Whether 'Buy Now' Means You Own Your PlayStation Games

Four California PlayStation buyers filed a class action against Sony Interactive Entertainment in June 2026, arguing the PlayStation Store misleads shoppers into thinking they own digital games they actually only license. The complaint targets checkout language like ‘Buy Now’ and ‘Confirm Purchase,’ contending that the small, unhighlighted disclosure noting the purchase is a revocable license falls short of the clear-and-conspicuous standard required by California’s new digital-goods transparency law (AB 2426, Cal. Bus. & Prof. Code § 17500.6). The plaintiffs also invoke the state’s False Advertising Law and Consumer Legal Remedies Act, and are seeking damages, restitution, and an injunction on behalf of a proposed statewide class, with the amount in controversy pegged above $5 million.

Sony’s August response leads with a motion to compel individual arbitration, pointing to a binding arbitration clause and class-action waiver buried in Section 14 of its Terms of Service — complete with a 30-day opt-out window that no plaintiff used. As a fallback, Sony argues on the merits that no reasonable consumer could believe they were buying outright ownership of a digital game, reasoning that shared multiplayer titles and simultaneous purchases of the same game by different buyers make exclusive ownership implausible. Critics have flagged the contradiction: Sony’s own support pages instruct buyers on upgrading ‘the digital PS4 game you already own,’ and add-on content requires possession of a base game the company now says buyers don’t own.

The timing sharpens the stakes. Digital already accounted for 85% of Sony’s game sales in the quarter ending March 2026, and Sony plans to end physical disc production for new PlayStation titles starting January 2028 — a shift that makes the licensing-versus-ownership question central to how console games are sold. A hearing on Sony’s motion is set for October 1, 2026, before Judge Vince Chhabria in the Northern District of California.
