Italian Campaign Presses Laptop Makers to Refund Unwanted Windows Licenses

A consumer-rights campaign backed by the Free Software Foundation Europe and the Italian Linux Society (refund4freedom.org) is pushing back against the practice of bundling a paid Windows license into nearly every laptop sold. The organizers argue that general-purpose devices should be neutral toward the software they run, and that buyers who don’t want Windows shouldn’t be forced to pay for it. Their demands are threefold: vendors shouldn’t impose an OS, pricing should be transparent enough to decline pre-installed software, and refunds should be simple rather than requiring you to ship the whole machine to a service center.

The site doubles as a practical playbook. It advises users to photograph or screen-record the license clauses before wiping the drive, to preserve all correspondence with the manufacturer, and to escalate to Italy’s AGCM antitrust authority if a refund is refused. It also ranks vendors by how they handle claims: Asus and Acer have procedures (Asus refunds €9–65 by email without shipping the unit; Acer requires shipping it in), Lenovo requires shipping to a service center, while HP and Dell offer no refund path at all — Dell’s terms even require returning the entire computer.

The collected case reports show that getting money back is often a war of attrition. Payouts typically land in the €40–75 range and frequently arrive only after PEC-certified legal emails, small-claims filings before a Justice of the Peace, or the threat of a hearing. One drawn-out Lenovo dispute ended with a court ordering not just a €42 license refund but €1,000 in legal fees and €20,000 in damages for bad-faith litigation — a reminder that the ‘Windows tax’ remains legally contestable in the EU even if enforcement is slow and case-by-case.
